The Wisconsin Supreme Court recently ruled that the state's removal of $200 million from the state medical malpractice fund in 2007 was unconstitutional. The court stated that "healthcare providers have a constitutionally protected property interest in the fund" and ordered that the $200 million be repaid.
Doctors in Wisconsin are required to purchase malpractice insurance for at least $1 million per occurrence and $3 million aggregate annually. In addition, approximately 13,000 healthcare providers in Wisconsin contribute to the state's medical malpractice funds so when the $200 million was removed doctors' malpractice insurance rates spiked by almost 10 percent.
