$250K Judgement in CT Slip and Fall Lawsuit
Posted on Tuesday, July 12th, 2011 at 8:22 am
A Connecticut couple has been awarded a $250,000 judgment in
a slip and fall lawsuit filed against a gas station chain.
According to court documents, the parent company of the
North Platte Sun-Mart stores was hit with a $250,000 judgment after a four-day
trial wrapped up a nearly three-year-long lawsuit over a slip and fall at a
store. The lawsuit claimed gas station chain Nash Finch was negligent in
failing to purchase and maintain floors in a way that would make them
slip-resistent.
According to the lawsuit, Diane Derra was grocery shopping
on New Year’s Day 2007 when she slipped on a wet floor in a public section of
the store. The complaint alleged that Nash Finch “created and/or otherwise
failed to prevent a hazardous and slippery condition of a floor that it knew,
or should have known, when wet is a trap for the unwary and unwarned public
capable of causing serious injury and/or death to its patrons.”
The plaintiffs claimed Nash Finch failed to take action even
though it knew that during the winter months the floors of the gas station “could
become wet from patron spills, outside weather conditions, or self service
drink and ice dispensers.”
The Derras sought damages including $50,000 in medical
expenses, as well as all future medical expenses including nursing home care.
Payment for permanent physical disabilities, pain and suffering, and loss of enjoyment
of life was also sought.

Doctor Cleared of Negligence in Nursing Home Malpractice Lawsuit
Posted on Tuesday, July 5th, 2011 at 7:07 am
A jury in Texas has cleared a physician of negligence in a
nursing home malpractice lawsuit.
According to Jefferson County District Court documents,
jurors found no negligence on the part of Dr. Shariq Ahmad in the death of Emma
Lee Randolph. The nursing home malpractice lawsuit claimed Ahmad failed to
attend to Randolph’s nutritional and medical needs.
According to the lawsuit, Randolph was admitted to Silsbee
Oaks Nursing Home on January 18, 2006. During her stay, she was required to go
to The Kidney Center in Beaumont for dialysis several times a week. The lawsuit
claimed that during these visits, “the staff at the Kidney Center did not care for
Ms. Randolph. They allowed her to sit in a wheelchair without being
repositioned, without receiving incontinent care, without receiving adequate
nutrition, and without receiving adequate hydration.”
The lawsuit also alleges that the physicians at the Kidney
Center did not attend to her nutritional needs and she was not assisted with
eating or drinking during the time she was there. “Despite being repeatedly
warned by the nursing home staff that these failures would be catastrophic to
Ms. Randolph, the physicians and staff at the Kidney Center did nothing to
improve and as a result, Ms. Randolph became dehydrated, malnourished, and
developed severe bedsores, which later became infected,” the lawsuit says.
The jury declined to award any damages to the defendants,
finding no evidence of negligence on Ahmad’s part.
